Your Guide to Fundertable’s Online Store Terms

Welcome! Here, you will find all the relevant information for using our online shop, including how to place orders, payment and delivery options, returns and refunds, and complaint procedures.

§ 1: Definitions
In these Terms and Conditions:

  1. Buyer – A natural person, legal entity, or an organizational unit without legal personality.
  2. Consumer – A natural person entering into a contract with the Seller that is not directly related to their business or professional activity.
  3. Entrepreneur with Consumer Rights – An individual entering into a contract directly related to their business but which does not fall within the professional scope of that business.
  4. Terms and Conditions – This document, accessible at fundertable.com/terms-and-conditions.
  5. Shop – The online store located at www.fundertable.com.
  6. Seller – Joanna Wojciechowska, conducting business as “HOHONIE Joanna Wojciechowska,” located at Adama Wodziczki 1/20, 62-040 Puszczykowo, Poland, Tax ID: 7772186882.

§ 2: General Provisions

  1. Through the Shop, the Seller offers physical products and gift cards, while providing electronic services to Buyers.
  2. These Terms and Conditions outline the rules for using the Shop and the rights and obligations of the Seller and Buyers.
  3. No special technical requirements are needed to use the Shop—just an internet connection, standard browser, and active email.
  4. Anonymous purchases or using a pseudonym is not allowed.
  5. Providing unlawful content is prohibited.
  6. All prices are inclusive of VAT (gross).

§ 3: Electronic Services

  1. The primary service provided electronically to Buyers is the ability to place orders in the Shop.
  2. Account creation is optional and allows the storage of order history. You can delete your account anytime.
  3. Newsletter subscription enables updates on new products and promotions. You may unsubscribe at any time.
  4. All electronic services are free, but payment is required for product purchases.
  5. We implement safety measures to protect your data and ensure secure transactions.
  6. Report any Shop issues to us, and we’ll address them promptly.
  7. For complaints, email us at office@fundertable.com with details of the issue. We respond within 30 days.

§ 4: Placing an Order

  1. Add items to your cart, complete the order form, select delivery and payment methods, and accept these Terms and Conditions.
  2. Click the final confirmation button to complete your purchase and form a sales contract with the Seller.
  3. For online payment, you will be redirected to a secure payment gateway.
  4. Enter accurate information. We may verify details if necessary, and inaccurate data may lead to order delays.

§ 5: Delivery and Payment

  1. Available delivery options for an order are presented to the Buyer during the checkout process. Delivery costs are borne by the Buyer unless the Seller indicates otherwise on the Store’s website.
  2. The available payment methods are shown to the Buyer during the checkout process.
  3. Electronic payments are processed, depending on the payment method selected by the Buyer
  4. Payment can be made via online transfer or by payment card (Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro). In cases where a refund is required for a transaction made by the Buyer with a payment card, the Seller will issue the refund to the bank account linked to the Buyer’s payment card unless the Buyer has explicitly agreed to a different refund method that incurs no additional costs.
  5. Payment can also be made via a traditional bank transfer.Bank transfer details:

    Please include your order number in the transfer title to help the Seller identify the transaction.

    Please note that traditional bank transfers require the payment to be credited before the order is shipped, which may result in a longer delivery time.

  6. If the Buyer has requested an invoice, it will be sent electronically to the email address provided in the order form.

§ 6: Order Fulfillment

  1. Order fulfillment involves preparing, packaging, and shipping the items according to your chosen delivery method.
  2. Orders are fulfilled when handed over to the carrier.
  3. Standard processing time is displayed on product pages, generally up to 14 days unless specified otherwise.
  4. Custom orders may require additional time; we will provide an estimated timeline.

§ 7: Gift Cards

  1. Gift cards are available in specific denominations.
  2. Enter the gift card code at checkout to reduce the order amount. Additional payment is required if the order exceeds the card’s value.
  3. Gift cards are sent electronically and can be printed or shared.
  4. Gift cards are valid indefinitely while the Shop is active and are non-refundable.

§ 8: Returns for Consumers or Entrepreneurs with Consumer Rights

  1. You have 14 days to return items without providing a reason.
  2. Notify us by email or in writing to initiate a return. You may use our return form at fundertable.com.
  3. Return items in their original condition within 14 days of notifying us. Buyers cover return shipping costs.
  4. Refunds are processed within 14 days of receiving the return and are made to the original payment method.

§ 9: Warranty for Defects

  1. We ensure products are free from defects.
  2. If there’s a defect, you may request a replacement, repair, price reduction, or refund.
  3. Report defects by contacting us with details of your preferred resolution.

§ 10: Personal Data and Cookies

  1. The Seller administers Buyers’ personal data.
  2. Our Shop uses cookies. For details, see our privacy policy at fundertable.com.

§ 11: Intellectual Property Rights

  1. Content on the Shop, including product designs, may be protected by copyright. Unauthorized use beyond personal purposes may lead to legal action.

§ 12: Alternative Dispute Resolution

  1. We agree to consider mediation for disputes, with terms set by both parties.
  2. Consumers can explore alternative dispute resolution methods:
    o Mediation or assistance from local consumer protection organizations,
    o Use of the EU online dispute resolution platform at ec.europa.eu/consumers/odr.

§ 13: Final Provisions

  1. We may modify these Terms and Conditions, prices, and promotions. Changes won’t affect orders placed before they take effect.
  2. Disputes will be settled by Polish courts, except for Consumers and Entrepreneurs with Consumer Rights, who may follow general jurisdiction rules.
  3. These Terms and Conditions are effective from November 1, 2024.
